General terms and conditions of

Portland Hearts of Pine

By purchasing tickets to Hearts of Pine (“Hearts”) events and/or attending Hearts events, Customers agree to abide by the following terms and conditions.

TERMS OF USE AND PRIVACY POLICY

Hearts of Pine is a member of the “USL Family” and is subject to the USL Terms of Use(opens in a new tab) and USL Privacy Policy(opens in a new tab)

OTHER GENERAL TERMS AND CONDITIONS

1. Broadcast & Imagery: Customers agree not to transmit, distribute or sell (or aid in transmitting, distributing or selling) in any media now or hereafter existing, any description, account, picture, video, audio or other form of reproduction of the Event or any Event-related activities, other than for personal non-commercial use, unless granted express written permission by Hearts of Pine. Attendees of Hearts matches and events grant permission to Management (including their respective affiliates, employees, officers, directors, members, partners, owners, sponsors, agents, independent contractors or representatives) to utilize images, likenesses, actions and statements, in perpetuity, in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the Event in any medium or context for any purpose, including commercial or promotional purposes, without further authorization from or compensation to the Customer.

2. Communication: When purchasing a ticket to Hearts of Pine, Customers agree to be contacted by mail, email, phone, and/or SMS regarding account information and purchases. Customers can opt out of this communication by contacting tickets@heartsofpine.com.

3. Fan Code of Conduct: Attendees of Hearts events agree to comply with the Fan Code of Conduct.

4. Ticket Terms & Spectator Waiver: Attendees of Hearts events agree to comply with the Hearts Ticket Terms & Spectator Waiver.

SEASON TICKET MEMBER TERMS AND CONDITIONS

A Membership cannot be suspended for any period of time. If a Member chooses to cancel the Membership for any period, the Member will need to re-establish Membership, subject to availability, and be subject to the then-current Member pricing and benefits.

PAY AS WE PLAY PROGRAM (for Additional Matches & Playoffs):

Members in good standing shall be automatically enrolled in the Pay As We Play program (“Pay-As-We-Play Program”), and shall have the opportunity to purchase tickets for certain events which fall outside the Season Ticket Membership Benefits and which may include one or more rounds of competition at Portland Hearts of Pine’s sole discretion, including but not limited to USL Playoffs, Leagues Cup matches, CONCACAF Champions League matches, Lamar Hunt U.S. Open Cup/Canadian Championship matches, USL League One Playoffs and other similar matches designated by Portland Hearts of Pine (individually “Pay-As-We-Play Matches” and collectively, the “Pay-As-We-Play Matches”).

Following the public announcement of one or multiple Pay-As-We-Play Match(es), Portland Hearts of Pine shall provide all Members with notice that such event(s) constitutes a Pay-As-We-Play Match and shall further provide all Members with an invoice for the price of tickets to the same Pay-As-We-Play Match(es). All invoices generated for Pay-As-We-Play Matches shall be for the same seats in the Member’s Membership for the then-current season, and the invoice shall list the per seat price for all Pay-As-We-Play Matches included in the invoice.

Each Member shall further be provided with the time period and manner for providing notice to Portland Hearts of Pine that Member does not wish to purchase tickets for the invoiced Pay-As-We-Play Match(es) (“Opt Out”), which time period shall in no event be sooner than forty-eight (48) hours after Portland Hearts of Pine provides notice of the Event’s designation as an Pay-As-We-Play Match (“Opt-Out Period”).

If Member does not Opt Out within the Opt-Out Period, Member authorizes Portland Hearts of Pine and Portland Hearts of Pine ticket agents to charge their credit card or bank account on file with Portland Hearts of Pine in Member’s account on the first date immediately following each Opt-Out Period for the full invoice amount in one lump sum (unless a payment plan is offered through the invoice). Opting Out of any specific invoice during any Opt-Out Period shall release Member’s tickets for the associated event(s) back to Portland Hearts of Pine for sale as part of general single match inventory for the event(s).

If multiple events are offered in an invoice, for example all home USL Playoff matches, once Opting Out of the first event in the series, Member shall be Opted Out for all remaining events in that series, including but not limited to later rounds of competition, (e.g., a Conference Final), and shall not be guaranteed any subsequent opportunity to purchase tickets on a single match basis.

SEASON TICKET PAYMENT AND MEMBERSHIP AUTO-RENEWAL

When purchasing a Season Ticket Membership, Customer gives authorization to Hearts of Pine LLC (“Hearts”) to charge their credit/debit card (or withdraw from their bank account via Electronic Funds Transfer, if so selected by the Customer) for their annual Season Ticket Membership dues and agrees to the terms and conditions listed herein.

Subsequent installment charges, if any, will be made to their authorized card/account in association with their chosen payment plan until their annual dues are paid in full. Hearts reserves the right to charge a late fee of up to $25 per occasion in the event that any Membership payment is delinquent for a period of ten (10) days or more.

By purchasing a Season Ticket Membership, Customer also agrees to enter Portland Hearts of Pine’s automatic renewal Membership program. Under this program, Membership will automatically renew at the Club’s designated renewal date for the next Season. Their Season Ticket Membership will automatically renew at the Club’s designated renewal date of each successive Membership Year, unless either the Member or Hearts provides written notice of cancellation.

Each year, Hearts will send a renewal notice to Members at least thirty (30) days prior to Club’s designated renewal date (tentatively scheduled for mid-August). Unless the Member provides notice of cancellation to Hearts prior to the designated renewal date, their tickets shall be automatically renewed for the upcoming Season and their first payment shall be due and payable in accordance with the payment option selected under the Agreement. (Note: If Members desire to select a different payment plan, they may do so by informing Hearts prior to the Club’s designated renewal date each year. No change in a payment plan will be effective until confirmed by Portland Hearts of Pine.)

Upon cancellation, Customer will no longer be obligated for any future payments, but shall not be entitled to any refund for installment payments made prior to the cancellation. For all membership payments, the foregoing payment authorization shall remain in effect for so long as their Season Ticket Membership remains in effect. Hearts reserves the right, upon written notification, to modify the payment plan, including pricing, for future seasons and/or terminate my participation as a Season Ticket Member for any reason, including without limitation, the purchase of season tickets with the sole intent to resell, violations of this agreement or any applicable Hearts or venue rules, regulations or policies (including the Hearts of Pine Fan Code of Conduct). Customer will be bound and agree to abide by any modification or amendment of the foregoing rules, regulations & policies as may apply from time to time.
